McCain's Call "Bomb Iran And Syria" In War Championing US Not Prosecutable?

By Jay Janson

12 March, 2012
Countercurrents.org

Which side of the fence does is the reader on? The side of McCain, hailed by media as a hero bomber, and all those elected and would-be-elected politicians calling for bombing of yet another small nation?  Or on the side of law, the Nuremberg Principles, the General Treaty for the Renunciation of War,   both integral parts of the US Constitution, and a prosecute campaign? Most war-funding tax payers are sitting on this fence

Senator John McCain, a chief promoter of Wall Street wars for predatory investments, steadfastly dismissive and contemptuous of Nuremberg Chief Prosecutor Telford Taylors's publicized desire to have prosecuted him for bombing civilian populations of Vietnamese cities, has added demands to bomb Syria to his calls to bomb Iran (that he was prominent in the calling to bomb Libya, goes without saying.)

McCain Calls for U.S.-Led Airstrikes in Syria, New York Times, 3/10/2012 "Senator John McCain called on Monday for the United States to lead airstrikes against Syria's armed forces to protect the rebels and civilians there, much as it did in Libya last year."

The world hears the same humanitarian intervention lie over and over and over again since Korea in 1950.

Perceptive readers will note that the New York Times article is published under the news section over-title " AT WAR News from the Front Lines ", unmistakably sending out the message that the Times publishers consider the US front-line running through the Syrian population.

In Senator McCain, we have an ex-US Navy pilot who followed criminal orders to bomb populated cities during an undeclared war in a small French colony, who to this authors knowledge, has never sought to find out how many men, women and children his dropped bombs brought death or maiming to and has never sought to apologize or make any sort of restitution, even after Vietnam war era Secretary of Defense wrote a whole book to express his confession that the war, which took the lives of nearly five million innocent and poor inhabitants of what was the French colonized Indochinese peninsula, was a mistake.

U.S. Nuremberg Trials Prosecutor Would Have Proudly Prosecuted McCain As a War Criminal , History News Network, 10/10/2008
Whew, what a great American! - a hero for the commercial media militarized  citenzenry of the extensive American empire straddling the globe with branches of it mamoth investment banks and bases of its Army, Navy and Air Force. A citizenry long used to being content with entertainment news that promotes all kinds of fairy tales of good-guy Americans like McCain.

With corporatist media squelching all free flow of information, few Americans ever read of McCain's sleighting of the simple Vietnamese soul who risked his life to save McCain from drowning in his parachute and from being killed by an enraged mob of Hanoi residents. But Americans heard plenty about the Senator's theatrical return to Hanoi decades after he mercilessly bombed it and reenact his fall into one of Hanoi's beautiful lakes.

Now on McCain's side of the fence there are three Republican candidates for President, well reported upon in recent OpEdNews, 2/6/2012
Three GOP Presidentials Commit Crime Against Peace Under Nuremberg Principles . The synopsis adds in corporatist media to the side of those fomenting bombing and hyping up reasons to bomb.
Synopsis: "Mitt, Newt, Rick vow to bomb a foreign nation, a crime against peace indictable under Nuremberg Principles, which, when they was signed automatically became part of the US constitution. At Nuremberg, Nazi media personalities were indicted for promoting war. They stood alongside Nazi officials who ordered the wars and generals who executed criminal orders. Note: During Superbowl games the US is usually bombing poor people."

More importantly of course, we have President Obama, winner of the Nobel Peace Prize, already since his taking office threatening to bomb, even nuclear bomb Iran, then having ordered the bombing of Libya, now considering McCain's demand to bomb Syria.

On the other side of the fence we have law, and laws for the protection of humanity (of which of course Iran, Syria and Libya are a part), and a campaign to bring the full weight of those laws to bear, namely, the

PROSECUTE US CRIMES AGAINST HUMANITY NOW CAMPAIGN
in the name of the Martin Luther King Jr.' anguished cry "My country is the greatest purveyor of violence in the world today."

The first goal of this campaign is to frighten with prosecution anyone calling for, or fomenting war or military attack on an other nation in violation of international/national Law Nuremberg Principle #6 regarding Crimes Against Peace, thus inhibiting and preventing new wars from being created (This would include mesia war mongering, by serious discussions of pros and cons of a US military attack or unlawful sanctions), simultaneously, arrest and indictment for present and past crimes against humanity.

Also on the opposite side of the call for illegal undeclared wars and constant war mongering is The General Treaty for the Renunciation of War ,  The World Peace Act, previously The Kellogg-Briand Pact, became part of the US Constitution  (as did Article 6 and 7 of the Nuremberg Principles twenty-two years later), upon being approved by the US Senate 85-1 and reads:

"The High Contracting Parties solemnly declare in the names of their respective peoples that they condemn recourse to war for the solution of international controversies, and renounce it, as an instrument of national policy in their relations with one another."

The 1928 World Peace Act was concluded outside the League of Nations, and remains a binding treaty under international law. In the United States, it remains in force as federal law (see U.S. Constitution , article VI). One month following its conclusion, a similar agreement, General Act for the Pacific Settlement of International Disputes, was concluded in Geneva, which obliged its signatory parties to establish conciliation commissions and an arbitration tribunal in any case of dispute, and the opportunity to take failed disputes to the Permanent Court of International Justice.

Article VI Clause 2 of the US Constitution states that "All Treaties made, under the Authority of the United State, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, anything in the Constitution or Laws of any State to the contrary notwithstanding."

Your servant and today's author would like the reader to decide which side of the fence he or she finds him or herself - hopefully not sitting on the fence as are the grand majority of tax paying, war supporting citizens.
